Binance faces EU scrutiny for serving customers after missing MiCA's July 1 deadline via reverse solicitation and Abu Dhabi routing. ESMA and regulators in France, Germany and Greece are probing compliance as licensed rivals like Coinbase and Kraken gain full passporting advantage.

The world’s largest cryptocurrency exchange is now the first case study for MiCA reverse solicitation under the EU’s Markets in Crypto-Assets regime. After missing the July 1, 2026 authorisation deadline for the MiCA regime, Binance is now under scrutiny for allegedly continuing to serve European consumers under a narrow carve-out never intended to apply to mass-market service providers.

Per the Financial Times, syndicated by Reuters on October 1, regulators in the Financial Action Task Force member states of France, Germany, and Greece, as well as the European Securities and Markets Authority, are assessing whether Binance improperly exploited the MiCA reverse solicitation clause. This will set the tone for how stringently Europe ends its transitional period.

Binance applied for a license from Greece’s Hellenic Capital Market Commission under the EU’s Markets in Crypto-Assets regime but had withdrawn its application by June 24, 2026, on news that rejection was imminent. Though informing users in Poland, Italy, Spain, and France of a wind-down, the platform continued onboarding after July 1 by invoking MiCA reverse solicitation.

Regulators mention two workarounds. Firstly, reverse solicitation (an exception under MiCA allowing a third-country company to operate within the EU if a client actively seeks out the company and not vice versa).

Secondly, routing some EU trades through a Binance branch in Abu Dhabi. ESMA has requested reports to determine whether this MiCA reverse solicitation setup is in fact a continuation of services. Ongoing platforms include ESMA, the AMF (France), BaFin (Germany), HCMC (Greece) and Binance itself. Should this application not succeed, Binance may face penalties or an injunction to halt all activity in the EU.

Why Is MiCA Matter for Investors and Exchanges

MiCA’s passporting enables a CASP authorized in one state to provide services throughout all 27 States. ESMA reaffirmed the end of MiCA’s interim periods in April 2026, and upheld the narrowest interpretation of MiCA reverse solicitation in July 2026, preventing recourse to avoid MiCA. For investors and institutions, the case adds clarity around counterparty risk.

ESMA aggregated data from August 2026 reported that 281 of 1,343 providers operating in the EU had achieved authorisation by the deadline, with 12 per cent of non-authorised companies deemed high or serious risk, compared with 2 per cent for authorised companies. For exchanges and developers, ESMA’s MiCA reverse solicitation precedent is essential. A lax interpretation of MiCA reverse solicitation would compromise MiCA’s level playing field. A tougher approach tightens compliance for platforms while deepening defences.
