Solana-Based TRUMP Token Sparks Legal Battle Over Gift Solicitation Laws

Public Citizen, a nonprofit watchdog group, has formally requested the Department of Justice and the Office of Government Ethics to investigate Donald Trump’s promotion of the Solana-based TRUMP token.

The organization alleges that Trump’s actions may violate laws prohibiting the solicitation of gifts, as 80% of the token’s supply is controlled by CIC Digital LLC—an entity affiliated with the Organization. This has raised concerns about potential untraceable foreign payments influencing the former president.

The complaint points to federal laws that restrict government officials, including the president, from soliciting or coercing the offering of gifts. While as a former president, he can receive gifts, soliciting funds through a cryptocurrency could create legal complications.

Public Citizen argues that by urging supporters to buy the token via social media posts, he is effectively soliciting financial contributions for personal gain, which falls outside legal exemptions.

Solana-Based TRUMP Token Sparks Legal and Ethical Concerns

The controversy stems from Trump’s relentless hyping of the token, most recently through his social platform, Truth Social. He urged followers to buy the virtual asset, hyping it as part of a cause that aligns with his values.

The token website claims CIC Digital LLC holds a controlling interest, directly enriching Trump. Others view it as a donation tool with no real product. There is concern about potential overseas purchases that could potentially funnel funds to Trump. Public Citizen is calling for an investigation, citing the U.S. Constitution’s Emoluments Clause.

Crypto Community Reacts as Political Controversy Grows

The crypto community is divided over the token, with one part of it portraying it as a meme coin and another part portraying it as unethical. Anthony Scaramucci labelled it political corruption, and critics labelled it a cash grab. Public Citizen’s complaint invites regulators to act over alleged abuses of the law, requesting sales to stop and a return of funds. With heightened regulatory scrutiny, his foray into crypto comes with legal concerns that can have a bearing in politics and in blockchain.
